1. Introduction
Welcome to Tratus. By using our services, you agree to these Terms of Service (TOS). Please read them carefully before engaging with our branding services. These terms are a legal agreement between you (the “Client”) and us.
2. Services Provided
We offer a variety of branding services, including but not limited to logo design, brand strategy, visual identity development, marketing campaigns, and digital content creation. We are committed to delivering high-quality branding solutions tailored to your business needs.
3. User Obligations
Clients agree to provide accurate, complete, and up-to-date information as necessary for the delivery of our services. You agree to comply with our instructions and feedback timelines to ensure timely project completion. Any misuse of our services or violation of these terms may result in termination of service.
4. Payment Terms
All payments for services are due as agreed upon in the contract. Payment methods include credit card, PayPal or bank transfer. We reserve the right to withhold deliverables until payment is made in full. Refunds are only provided under exceptional circumstances and are at our discretion.
5. Intellectual Property
Upon full payment, ownership of the final branding materials will be transferred to the Client. However, we retain the rights to all preliminary work, including drafts, concepts, and design methods. We reserve the right to showcase the final project in our portfolio unless otherwise agreed in writing.
6. Limitation of Liability
We are not responsible for any indirect, incidental, or consequential damages arising from the use or misuse of our services. Our liability for any claim shall not exceed the amount paid for the services in question.
7. Termination of Agreement
Either party may terminate the service agreement by giving written notice. Upon termination, any outstanding payments for completed work will be due. If a project is terminated before completion, we reserve the right to charge for the work completed up to the termination date.
8. Governing Law
These Terms of Service are governed by the laws of Malaysia. Any disputes shall be resolved in accordance with the applicable laws of that jurisdiction.
9. Amendments
We may update these terms from time to time. Clients will be notified of any significant changes. Continued use of our services after changes have been posted signifies your acceptance of the updated terms.
